Cyclem Terms and Conditions of Use

Purpose

The purpose of these General Terms and Conditions of Use (hereinafter the "GTCU") is to define the conditions under which Cyclem is made available to users.

Acceptance of the GCU

The use of Cyclem implies the full acceptance of the present GTU by the user. The GTU are made available to the user on the application. The user is invited to read them carefully before using the application.

Description of the application

Cyclem is a dynamic platform for buying and selling second-hand clothes online between private individuals, offering users a user-friendly and secure experience. Cyclem allows users to explore a wide range of fashion items, find unique and trendy pieces, and sell their own clothes in a simple and efficient way. Users can create detailed ads with descriptions and photos to showcase their items, while buyers can browse offers, interact with sellers and make purchases in complete confidence. Cyclem focuses on sustainability, reuse and recycling in the Swiss fashion industry, offering an eco-friendly alternative to buying new clothes. With an intuitive interface, advanced search functionalities and an engaged community, Cyclem aims to facilitate exchanges between fashion enthusiasts while promoting a more responsible mode of consumption.

Use of the application

Use in accordance with intended purpose and applicable laws: You agree to use Cyclem only for lawful purposes and in accordance with its intended purpose. You agree to comply with all applicable laws and regulations when using the application.

Age limit:

Cyclem is a platform for people aged 17 and over. By using the application, you confirm that you are 17 years of age or older. Any natural person wishing to use the Tripartie Services integrated into the application must be of legal age, capable and acting in his/her own name.

User responsibility:

You are entirely responsible for your actions and behavior when using Cyclem. This includes, but is not limited to, any content you post on the application, your interactions with other users, and compliance with applicable laws and regulations.

Accuracy of Information:

You agree to provide accurate and up-to-date information when using Cyclem. This includes your personal information, descriptions of items you sell, and any other data you share on the platform.

Responsibility for content:

You are entirely responsible for the content you publish on the application, including its truthfulness and accuracy. Infringement, distribution of illegal, defamatory, offensive, discriminatory or immoral content is strictly forbidden on Cyclem. Cyclem reserves the right to monitor, control, modify or delete user content, in whole or in part, if it believes that such content violates these TOU or any applicable law without prior notice. In addition, Cyclem reserves the right to ban users in the event of fraud, repeated non-compliance with the TOS or any other activity deemed detrimental to the application or its users.

Consent to use of data:

You consent to Cyclem's use of the content you post on the App for marketing or analytical purposes, in accordance with our Privacy Policy.

Reporting inappropriate content:

If you become aware of inappropriate content, such as offensive, discriminatory, illegal posts or posts that violate community standards, you are encouraged to report it immediately. Our team will review each report and take appropriate action as soon as possible, usually within 24 hours.

Disciplinary measures:

Users who violate Cyclem's terms of use may be subject to disciplinary measures, including warnings, temporary suspensions or permanent bans from the application. These measures will be taken at the discretion of our team, depending on the seriousness of the offence and the specific circumstances.

Personal data protection:

Personal data collected by Cyclem is processed in accordance with the Swiss Data Protection Act (DPA) and the European Union's General Data Protection Regulation (GDPR) (see privacy policy). You have the right to access, rectify and delete your personal data. You also consent to the processing of your personal data as described in our privacy policy.

Intellectual property :

All elements that make up the application are protected by intellectual property and belong to Swiss-web Ramadan. You agree not to reproduce, copy or use the elements of the application without prior authorization from the Cyclem team.By using Cyclem, you acknowledge your responsibility to comply with these guidelines and agree to contribute to maintaining a safe and respectful environment for all users.

Cyclem's responsibilities

As operator of Cyclem, we assume the following responsibilities:

Provision of service: Cyclem undertakes to provide the service in an efficient and secure manner, in accordance with these Terms of Use and the laws in force in Switzerland.

Application security: Cyclem undertakes to take all reasonable steps to ensure the security of the application and user data. However, in the event of unauthorized access, data breach or any other form of cyber attack resulting in theft or disclosure of user information, Cyclem disclaims all liability to the fullest extent permitted by applicable law.

Use in accordance with the GCU: Cyclem declines all responsibility in the event of use of the application by users contrary to the General Conditions of Use (GCU). Counterfeiting, distribution of illegal, defamatory, offensive, discriminatory or immoral content is strictly forbidden on Cyclem.

Intermediary between buyers and sellers: Cyclem acts as an intermediary by putting buyers and sellers in contact on the platform, but does not take part in the transaction itself. Consequently, Cyclem cannot be held responsible in the event of fraud, scam or direct or indirect damage resulting from the use of the application.

Processing of personal data: Cyclem undertakes to process users' personal data in accordance with the Swiss Data Protection Act (DPA) and the European Union's General Data Protection Regulation (GDPR). We respect the privacy of our users and are committed to protecting their data in accordance with our privacy policy.

Content moderation: Cyclem reserves the right to monitor, control, modify or remove user content, in whole or in part, if it believes that such content violates these TOU or any applicable law. We are committed to acting promptly and fairly to maintain a safe and respectful environment for all users.

Continuous improvement: We are committed to continuously improving the application to provide an optimal user experience, taking into account the comments and suggestions of our users.


Prices and payments

Free application: The Cyclem application is completely free to use. No fees are charged to sellers, allowing them to sell their items in unlimited numbers without ever paying a fee.

Integrated purchases and paid subscriptions: Although the application is free, we offer integrated purchases as well as paid subscriptions that confer certain benefits on users. These options may include premium features and exclusive benefits. Details of integrated purchases and paid subscriptions are available on the "subscription" screen accessible via the settings. Cyclem also reserves the right to modify the prices of integrated purchases at any time.

Security of payments and parcel shipments: Payments and parcel shipments made on the Cyclem application are secured by our trusted partner Tripartie. Each user wishing to secure a transaction via Tripartie must first accept the related terms and conditions (click here to consult Tripartie's terms and conditions). Cyclem does not collect, store or share user payment information, thus guaranteeing the confidentiality and security of financial data.


End user license agreement

The Cyclem End User License Agreement is governed by the EULA (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/).

Changes to the GGU

The Cyclem team reserves the right to modify the CGU at any time. Modifications will be effective as soon as they are posted on the application.

Applicable law and jurisdiction

These CGU are governed by Swiss law. Any dispute relating to the GCU shall be submitted to the competent Swiss jurisdiction.
